Noren & Polito on Law360 Pro Say Podcast for MSG Attorney Ban
January 30, 2023 – Ben Noren and Joe Polito, attorneys in the Commercial Litigation practice were guests on the Law360 Pro Say podcast’s “Courtside to Courtroom: Inside MSG’s Attorney Ban” episode discussing their experiences at being barred from entering any MSG Entertainment owned venues and the actions the firm has taken in response.
Polito, one of the lead attorneys on DHC’s ongoing legal action against MSG, spoke about the initial case that resulted in all of firm’s attorneys being banned from MSG venues, as well as the use of New York Civil Rights Act Article 40-B, which prevents any person over the age of 21 with a ticket from being denied admission to places of public entertainment and amusement, to successfully achieve a temporary injunction against MSG’s practices.
Noren shared audio from his experience trying to attend a rap concert at Madison Square Garden, when he was flagged due to MSG’s use of advanced facial recognition technology. He discussed the experience of being unceremoniously stopped at security and prevented from entering the venue, despite having Jude Lyle Frank’s injunction in hand.
Their in-depth discussion delves into the ongoing issues surrounding MSG’s use of facial recognition technology to ban attorneys from their venue. The podcast is an insightful and fascinating chapter in this ongoing legal saga.
