Terzulli in LIBN on Legal Cannabis Dispensaries Face Hurdles on Long Island

August 28, 2025 – After a rocky start, New York’s legal cannabis market is starting to gain traction, even as operators continue to grapple with high costs, inconsistent regulation, and competition from unlicensed sellers. And while interest is growing—among both consumers and would-be entrepreneurs—industry experts warn that succeeding in this space requires more than just a license.

DHC senior counsel attorney Nicholas Terzulli, heads up our Cannabis Law Group and has helped businesses navigate this minefield of regulations. He spoke with Long Island Business News about the current state of the market. 

“It’s still a regulatory mess,” said Nick Terzulli, an attorney with Davidoff Hutcher & Citron who represents cannabis businesses across the state. “We’re seeing municipalities make it nearly impossible to find suitable properties. And now, even the state is admitting to misinterpreting its own proximity rules, throwing hundreds of businesses into legal limbo.” 

For those looking to break into the business now, Terzulli offers the bottom-line advice: Don’t go in underfunded, and don’t assume a license is enough.
